ICE and the Encroachment of Authoritarian Power

This comparison will demonstrate how Trump’s ICE forces are very similar to the Nazi Gestapo. By examining their powers and practices, it becomes clear that Trump’s use of ICE is part of a broader pattern showing his authoritarian mindset and desire to centralize power—essentially posturing toward dictatorship.

1. Both have the power to arrest someone without a warrant

ICE: Agents can arrest individuals without a warrant if they have “reason to believe” someone is removable (Immigration and Nationality Act § 287). 

Gestapo: Operated under “Schutzhaft” (protective custody), allowing warrantless arrests of political opponents.


2. Both have the right to imprison somebody without a trial

ICE: Detains undocumented immigrants in civil facilities without a criminal trial. Many face long detention periods before hearings.

Gestapo: Used concentration camps as “preventive detention” facilities where no trial was required.


3. Both have the power to deport somebody without due process

ICE: Expedited removal allows deportation without court hearings or access to a judge. 

Gestapo: Deported Jews, Roma, and political prisoners to camps and occupied territories without trials.


4. Both have the power to send somebody to a foreign concentration camp

ICE: Some deportees have been sent to prisons in Eswatini without legal representation. 

Gestapo: Deported Jews and others to Nazi camps outside Germany (Auschwitz, Dachau, Sobibor). 


5. They can both operate without habeas corpus

ICE: Many detainees cannot access habeas petitions due to rapid deportations or lack of legal counsel (Zadvydas v. Davis).

Gestapo: Hitler’s regime suspended habeas corpus after the Reichstag Fire Decree (1933).


6. They both could operate without government oversight

ICE: Relies on private prisons and secretive transfers, limiting oversight. 

Gestapo: Reported only to Himmler and Hitler, bypassing courts and parliament. Source: 


Conclusion: 
Each of these parallels demonstrates how ICE’s powers can resemble historical authoritarian practices. While ICE is not identical to the Gestapo, warrantless arrests, detention without trial, deportation without oversight, and lack of habeas corpus protections signal a drift toward authoritarian governance.
